Chief Justice of Pakistan, Asif Saeed Khosa took U-turn to revive Supreme Court jurisdiction u/a 184 (3) by fixing a petition on video leak for hearing. On the other hand, Imran Khan also took U-turn & his law Minister Farogh Naseem with Shehzad Akbar confirmed its concern in this episode. Hashmat Habib President Tehreek e Tahafuz e Adlia said while commenting on latest developments of Accountability judge Arshad Malik video episode.
The senior lawyer expressed his hope that Supreme Court before proceeding with the petition may suspend the sentence of Nawaz Sharif violative of Article10-A. Hashmat Habib said Law Minister & Shehzad Akbar abused their position during a press conference on non-admissible affidavit of Arshad Malik by saying that u/s 31 of NAO all persons involved in video and press conference can be tried and awarded 10 years RI.
He said it is a misfortune that to become more loyal than king they have quoted Section-31 wrongly so they should apologize and withdraw their threat.
Hashmat Habib said Section-31 is clear it says, “If any person concerned with inquiry, investigation & prosecution of a case consciously and deliberately…defeat inquiry and investigation under process before NAB he shall be guilty of an offense…” Supreme Court may summon them along with others, he added.
It may be mentioned here that Section 31.
(a) of NAO says that: “Notwithstanding anything contained in any other law for the time being in force, if any person concerned with the inquiry 2[,] investigation and prosecution of a case consciously and deliberately and with malice 3* compromises, hampers, misleads, jeopardizes or defeats an 4 [inquiry or] investigation of a case under process before NAB or any concerned agency or authority or the 5[Court or any other Court] he shall be 6[guilty of an offense under this Ordinance punishable with rigorous imprisonment for a term which may extend to ten years].
(b) No person will be proceeded 7[against] under this section except with the sanction of a committee 8[comprising] the Chairman NAB, Deputy Chairman NAB and the Prosecutor General Accountability.
